EAR99 determinations under Canada: what businesses must know

An exporter ships a batch of off-the-shelf electronic components to a distributor in Canada. The customs declaration reads "EAR99 – no licence required." The finance team closes the file. Two weeks later, the distributor re-exports part of the consignment to a third country, and the exporter learns – for the first time – that the components appear on Canada's Export Control List and required a Canadian export permit all along. The shipment was EAR99 under the United States Export Administration Regulations. It was not necessarily uncontrolled under Canadian law.

An EAR99 classification under the US Export Administration Regulations means a commercial item does not appear on the US Commerce Control List and does not require a US export licence to most destinations. It does not determine whether the same item is controlled under Canada's Export Control List, administered by Global Affairs Canada under the Export and Import Permits Act. The two systems classify independently, and an item can be EAR99 and still require a Canadian export permit. As of April 2026, businesses handling goods with cross-border US-Canada movement routinely encounter this misalignment, and the compliance gaps can be significant.

What does EAR99 mean, and why does it matter to Canadian exporters?

EAR99 is the residual designation in the US export-control system: an item that does not appear on the Commerce Control List (CCL, the US list of controlled goods and technologies maintained by the Bureau of Industry and Security) and is not otherwise subject to specific licensing requirements under the Export Administration Regulations (EAR). EAR99 status means the item can generally be exported or re-exported to most destinations without a US licence – but subject to end-use and end-user restrictions that remain in force regardless of classification.

Canadian businesses handle EAR99 items constantly. They appear in ordinary supply chains: laboratory consumables, standard commercial electronics, general industrial tooling. The misunderstanding arises because EAR99 is a US-law category. It answers only the US licensing question. It does not answer the Canadian one. Under the Export and Import Permits Act (EIPA) and the regulations made under it, Canada maintains its own Export Control List (ECL), which reflects both domestic policy objectives and Canada's commitments under the Wassenaar Arrangement, the Nuclear Suppliers Group, the Australia Group, and the Missile Technology Control Regime. An item absent from the CCL can still appear on the ECL.

Why does this cause problems in practice? Because exporters who have determined EAR99 status correctly under US law sometimes stop there. They treat EAR99 as a green light across the Canada-US border and beyond. In our experience, this is the single most common source of Canadian export-permit violations by otherwise compliant businesses.

How the Canadian export-control system works alongside EAR99

Canada's export-control authority sits with Global Affairs Canada (GAC), the department responsible for administering the EIPA and granting export permits. The EIPA creates the ECL and the Area Control List (ACL), and it gives GAC the power to require permits for exports of controlled goods and technology. The Special Economic Measures Act (SEMA) is a separate instrument that authorises Canada to impose sanctions – including trade prohibitions – in response to international crises. SEMA and the EIPA interact: a SEMA trade prohibition can restrict exports of items that would otherwise require only an ECL permit.

The ECL has multiple groups. Group 1 covers dual-use goods and technology. Groups 2 through 7 cover munitions, nuclear items, nuclear-related dual-use, chemical and biological agents and related equipment, crime-control items, and missile technology items respectively. An item's position on the CCL does not map directly to its position on the ECL, though the two lists share the same multilateral-control framework. A CCL-unclassified item can still appear in ECL Group 1 if Canada has independently assessed it as posing an unacceptable export risk.

The result is a regime that operates in parallel with, not as a complement to, the EAR. Step-by-step: how to determine whether an EAR99 item needs a Canadian export permit

The determination sequence for a Canadian export-permit assessment runs in four stages, each of which must be completed before moving to the next. Skipping a stage is the source of most compliance failures we encounter.

Stage 1 – Confirm the EAR99 status is correct. Before applying Canadian law, verify that the US EAR99 classification is current and correct. EAR99 determinations go stale. The CCL is updated periodically, and items added to the CCL after a prior assessment may no longer be EAR99. Exporters should maintain a dated record of each classification decision and review it when the item, its specification, or its intended use changes. This matters for the Canadian analysis because the starting point for ECL Group 1 assessment often draws on the same multilateral control parameters that BIS uses.

Stage 2 – Search the ECL independently. Run the item description, its technical parameters, and its function against the ECL. The ECL does not have a direct equivalent of the CCL's ECCN numbering system in the same form. Examiners work through the Group 1 dual-use technology entries by reference to item descriptions and performance thresholds. An item that falls below CCL control thresholds may still meet an ECL entry if Canada has set different threshold values. This step requires technical precision: the description on a commercial invoice is not sufficient.

Stage 3 – Check the ACL and SEMA trade prohibitions. Even if an item does not appear on the ECL, it may require a permit because the destination country is on Canada's ACL. Separately, SEMA regulations can impose sweeping trade prohibitions – including on items that would not normally be ECL-controlled – when targeted at a specific country or regime. SEMA trade prohibitions do not follow the ECL structure; they are standalone statutory instruments. They must be checked independently. Stage 4 – Assess end-use and end-user restrictions. Both the EAR and the Canadian regime attach restrictions at the end-user level that operate regardless of item classification. Under the EAR, General Prohibitions 5, 6, and 7 apply to EAR99 items when the exporter knows of a prohibited end-use or end-user. Under EIPA, GAC has the authority to deny a permit on public-policy grounds unrelated to the ECL, and it has exercised that authority in respect of items not otherwise controlled. An EAR99 item destined for a party on the BIS Entity List (a list of foreign parties subject to specific licensing requirements under the EAR) may require a US licence even at EAR99; a similar risk arises under Canadian law where the end-user is subject to a SEMA designation or a UN Security Council measure adopted into Canadian law.

Where the Canadian regime diverges from the US EAR

The most practically significant divergence between the EAR and the Canadian regime is in how the two systems treat control parameters for dual-use technology. The EAR is built on a detailed CCL structure using Export Control Classification Numbers (ECCNs) that specify item-type, performance thresholds, and reasons for control. The ECL does not replicate that structure in identical form. Canada has adopted the Wassenaar and other multilateral control schedules but has implemented them through its own list with its own numbering. An exporter who maps from EAR99 to "no CCL entry" and then assumes no ECL entry will miss items where Canada's implementation of the same multilateral controls captures goods that fall below the CCL threshold.

Deemed exports are a second point of divergence. Under the EAR, a deemed export is a release of controlled technology to a foreign national within the United States – treated as an export to the person's home country. BIS has enforcement authority over deemed exports. Canada has a comparable deemed-export concept under EIPA, but the administration and the record-keeping requirements differ from the US position. A business that has assessed its US deemed-export obligations under the EAR cannot assume an identical analysis satisfies its Canadian obligations.

A third divergence involves extraterritorial reach. The EAR applies to US-origin items, to items incorporating more than a de minimis proportion of US-controlled content, and to items produced using US-origin technology (the foreign-direct product rule). This means a Canadian exporter shipping goods that incorporate US-origin components may face US licence requirements in addition to Canadian permit requirements. The two regimes stack rather than substitute. Risk flags and common compliance failures

Certain patterns appear repeatedly in the EAR99 determinations we review on behalf of Canadian and cross-border businesses. Each represents a distinct category of compliance risk.

Relying on a prior EAR99 determination without redating it. A determination made two or three years ago may be correct but may not reflect subsequent changes to the CCL or the ECL. We have acted for businesses where a historic EAR99 classification was used to justify an export permit application under Canadian law, only for GAC to note that the item had been added to the ECL after the US classification date. The determination was accurate at the time it was made; it was not current at the time of export.

Treating an EAR99 item as automatically ACL-exempt. The ACL applies to exports to listed destinations regardless of item classification. Countries appear on the ACL because of Canadian foreign-policy considerations that may not mirror US designation practice. An item can be EAR99 and require a Canadian permit solely because of the ACL destination.

Missing SEMA layering. SEMA regulations are promulgated by statutory instrument and can expand the scope of controlled exports significantly beyond the ECL. A SEMA trade prohibition in force against a particular country can capture exports of commercial goods that carry no ECL entry. Businesses operating in sectors not ordinarily subject to export control – consumer goods, food technology, general industrial equipment – can be caught by SEMA measures they have not considered.

Ignoring re-export risk. EAR99 items sold by a Canadian company to a distributor in a third market may be re-exported onward by that distributor. If the onward destination is subject to a SEMA prohibition or a UN measure, the original Canadian exporter may carry residual liability depending on the documentation and contractual protections in place. Does your supply contract include an end-use certification? Have you built a re-export clause that is consistent with both the EIPA and the EAR?

Conflating sanctions screening with export-permit assessment. Sanctions screening – checking counterparties against consolidated lists – is a distinct process from export-permit assessment. Many businesses have strong screening programmes and poor classification records, or vice versa. Both are necessary. A transaction can clear an OFAC screen and a GAC permit application and still involve a SEMA breach, or a CCL violation, if the underlying item analysis is incomplete.

Cross-border and extraterritorial considerations

For businesses operating across the Canada-US border, the interaction between the EAR and Canadian export controls requires a layered analysis that addresses both regimes simultaneously. The EAR's foreign-direct product rule can extend US jurisdiction to Canadian-manufactured goods that incorporate US-origin technology, even where the Canadian manufacturer has no direct connection to the United States. This is a specific and often misunderstood aspect of the EAR's extraterritorial reach.

The de minimis rule under the EAR means that items destined for most countries need not obtain a US re-export licence if the US-controlled content represents a sufficiently small proportion of the total item value. The de minimis threshold is set in the EAR. For exports to certain destinations, however, the de minimis rule does not apply, and a US re-export licence may be required regardless of the proportion of US content. Canadian businesses exporting to those destinations must track the US-origin content in their products to assess whether the EAR applies to their exports independently of Canadian law.

At the same time, the EU's dual-use regulations apply to exports from EU member states and carry their own control lists and permit requirements. A Canadian business with EU operations – or a European business with a Canadian subsidiary – faces a three-regime analysis for any export involving EU, Canadian, and US-origin content. In our cross-border practice, we find that businesses with multi-jurisdiction manufacturing are most exposed to gaps because each legal entity manages the export-control question for its own jurisdiction, and the interaction between regimes is not always assessed centrally. The ECL, the CCL, and the EU dual-use schedule must be read together for items that move through multiple jurisdictions before reaching the ultimate end-user.

Switzerland, under SECO's export-control regime, and Australia, under DFAT's autonomous sanctions and export-control framework, impose comparable requirements for dual-use goods. Businesses exporting from or through those jurisdictions must apply the same discipline: item classification, destination check, end-user screen, and permit application where required. No single EAR99 determination discharges the obligation across all these regimes.
